The following terms of service govern all use of the appadia.com website, mobile applications and all content, services and products available at or through the website (“Service”). The Service is owned and operated by Appadia, Inc. (“Appadia”). By using the Service, you are agreeing to be bound by the following terms and conditions (“Terms of Service”).
Appadia, Inc. reserves the right to update and change the Terms of Service from time to time, once the changes have been made, Appadia will notify by email. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. By continuing to access or use the Site and Service after we have posted a modification to these Terms of Service on the Site or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms of Service. If the modified Terms of Service are not acceptable to you, your only recourse is to cease using the Site and Service. Violation of any of the terms below will result in the termination of your Account. You agree to use the Service at your own risk and subject to the terms set forth below.
You must be 13 years or older to use this Service. You must be a human. Accounts registered by bots or other automated methods are not permitted. You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process. You represent and warrant that any and all information you provide is accurate and complete in all respects. You are responsible for maintaining the security of your account and password. Appadia cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others, including without limitation those who have accounts under your account). You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any applicable laws (including but not limited to copyright laws). You may not sublicense or otherwise transfer your Account or use of the Service. You are solely responsible for all use of the Service through your Account. None of our services are an offer or promise to sell.
Appadia offers you the means of creating an App and submitting it for approval to multiple third party distribution platform App Stores. However, we cannot guarantee how long the review process may take, or that any such App Store will accept and publish the App, and you acknowledge and agree that we have no liability to you for any rejection of any App by any such App Store. Any App Store may not publish an App not meeting its own technical criteria or violating its own applicable general terms and conditions. The period of time required for the publication of an Application on such store may vary from one store to another. The payment period will begin when the App is submitted for review. You acknowledge and agree that no refund will be due to you from us in case of rejection from the App Store.
We may offer free trial subscriptions during which you may use the Service for the time period specified in the promotional offer (“Trial Period”). Free trial subscriptions may not be combined with any other offer and are only available to customers who do not currently have an Account at the time of registration, unless otherwise stated in the promotion details. You will receive a notice from us that your free Trial Period has ended and you will have the option to provide payment information in order to continue to use the Service. You may cancel your subscription at any time. Please see the Section below titled “Cancellation and Termination” for further information. If we have provided notice to you that your free Trial Period has ended, and you do not provide your payment information to use a paid version of the Service, you understand and agree that we may delete any of your Content within a commercially reasonable time after the expiration of the applicable Trial Period.
Payment, Refunds, Upgrading and Downgrading Terms
Unless otherwise agreed by Appadia, a valid credit card is required for paid subscription plans. The Service is billed in advance on a monthly, annually, or other periodic basis as may be agreed by Appadia and in any case is non-refundable. There will be no refunds or credits for partial periods of service, upgrade/downgrade refunds, or refunds for periods unused with an open account. For any upgrade or downgrade in plan level, you will automatically be charged the new rate on your next billing cycle. Downgrading your Service may cause the loss of Content, features, or capacity of your Account. Appadia is not and shall not be liable for any such loss.
Cancellation and Termination
We store data until it is no longer necessary to provide our services, or until your account is deleted – whichever comes first. You are solely responsible for properly canceling your account. When deleting an account, please send an email to email@example.com or phone request to cancel your account is not considered as cancellation. You can cancel your account at any time by selecting Manage account and delete account section, you will need to add your password to continue. All of your Content will be immediately deleted from the Service upon cancellation. This information cannot be recovered once your account is cancelled. Appadia is not and shall not be liable for the loss of any Content. If you cancel the Service before the end of your current paid up period, your cancellation will take effect immediately and you will not be charged again. There will be no proration of unused subscription or refund of unused fees. Appadia, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Appadia service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. Appadia reserves the right to refuse service to anyone for any reason at any time. Appadia is not and shall not be liable for any related losses. Without limiting the foregoing, Appadia may, at any time and for any reason or no reason, suspend, terminate, or delete any free Accounts (and all related Content) that are inactive for a period of two months or more.
As an app user you can send an email to firstname.lastname@example.org in order to deactivate your account. All the information stored on your profile will be deleted (email, phone, password, saved information and notification preferences). Please note this might take up to 30 days.
Modifications to the Service and Prices
Appadia reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without prior notice. Prices for the Service, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Site or via the Service itself. Appadia shall not be liable to you or to any third party for any of the actions or inactions of its third party business partners regarding modification, price changes, suspension or discontinuance of the services of such third party business partners which work or integrate with the Service.
Our Service may contain links to third-party Web sites, advertisements, services, special offers, or other events, activities, or content (“Third-Party Materials”). Third-Party Materials are not controlled, monitored or endorsed by Appadia. Appadia is not responsible or liable for your use of or access to Third-Party Materials. Any activity outside of our Service will not be governed by our Terms of Service. Trademarks, product names, and logos appearing on our Service are the property of their respective owners. Reference to Third-Party products, services, process, or other information does not constitute or imply endorsement, sponsorship, or recommendation by Appadia. Appadia does not assert copyright or grant rights to the images or descriptions of the content that may be contained in our search results. Any use of the source images or descriptions is subject to the copyright owner’s permission and/or the requirements of applicable law. Appadia takes no responsibility and assumes no liability for any user generated content, including links to web pages, that you or any other user or third party posts or transmits using our Service. You understand and agree that you may be exposed to user content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose. Retail professionals agree to not use any information about Appadia users that is transferred to you during your use of Appadia’s Service for any reason except to provide those users with retail services. You agree never to use such information for any illegal or harmful purpose.
By creating your Appadia profile, you are subscribing to receive Email Newsletters and promotional offers from Appadia. This information settings will be saved at Appadia’s database until the user unsubscribes from these services.
To unsubscribe, you may click on the “Unsubscribe” button located at the bottom of any email you have received from Appadia, or email the word “Unsubscribe” to email@example.com. Please allow 2 to 3 days for us to process your request.
Copyright, Trademark, and Content Ownership
All content posted on the Service must comply with U.S. copyright law. Appadia claims no intellectual property rights over the material you provide to the Service. As between you and Appadia, your profile and materials uploaded remain yours. However, by sharing your pages, you agree to allow others to view and share your Content. Appadia is not responsible for the use of your Content by others. Appadia does not pre-screen Content and is not responsible for Content, whether provided by you or any other user of the Service. However, Appadia and its designees have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service. You may not duplicate, copy, or reuse any portion of the HTML/CSS or visual design elements without express written permission from Appadia, which permission may be withheld, conditioned, or delayed in Appadia’s sole discretion.
Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis. Without limiting the foregoing, Appadia is not responsible for any losses or corruption of Content. You acknowledge that Appadia has no obligation to monitor your access to or use of the Site or Service, or to review or edit any Content, but has the right to do so for the purpose of operating the Site and Services, to ensure your compliance with these Terms of Service, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. Appadia reserves the right, at any time and without prior notice, to remove or disable access to any Content and Accounts we determine in our sole discretion to be in violation of these Terms or otherwise harmful to the Site or Service. You understand that Appadia uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, or any other Appadia service. You agree not to reproduce, duplicate, copy, reverse engineer, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Appadia. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Appadia customer, employee, member, or officer will result in immediate Account termination. You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. You must not upload, post, host, or transmit unsolicited email, SMSs, or “spam” messages. You must not transmit any worms or viruses or any code of a destructive nature. You acknowledge and agree that you are each waiving the right to participate as a plaintiff or class member in any purported class action or representative proceeding. Further, more than one person’s claims may not be consolidated under any circumstances, in any form of any class or representative proceeding or otherwise.
Limitation of Liability
You expressly understand and agree that Appadia shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Appadia has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; (v) or any other matter relating to the Service. In no event shall Appadia’s liability to you exceed the amount actually paid to Appadia by you during the preceding 12 months.
